Terms and conditions of the Quasimodo GmbH
1. Field of application
1.1
These terms and conditions regulate the legal relation between the Quasimodo GmbH (‚Quasimodo’ in the following) and the obtainers of tickets, respectively the visitors of events (‚customer’ in the following) in the ‚Quasimodo’.
1.2
If the concert promoter of an event in the ‚Quasimodo’ is not the Quasimodo itself, the terms and conditions of the external promoter solely apply. In this case, the contract is between the promoter and the customer; ‘Quasimodo’ is not the contractual partner of the customer then.
2. Ticket presales
2.1
Tickets for Quasimodo events may be obtained without additional presales charges, by cash payment only, in the Quasimodo Café.
2.2
Eintrittskarten können auch über die Website des Quasimodo oder sonstige Vorverkaufsstellen erworben werden. Für den Erwerb von Eintrittskarten über die Website gilt folgendes:
Tickets may also be obtained via our website or other box offices. When obtaining tickets via our website, the following applies: Additionally to the ticket price, processing and presales fees are charged. If desired, the tickets can be sent by mail. We will send the tickets by registered mail, this results in an additional postal fee of € 3,90. If desired and particularly indicated by the customer, we will send tickets by certified mail, resulting in an additional fee of € 2,00. Sending the tickets by mail is totally at the customers’ risk. If tickets get lost in the mail, ‘Quasimodo’ will transfer its claims against the Deutsche Post AG (German postal service) to the customer. ‘Quasimodo’ hereby notifies that the maximum damage claim against the Deutsche Post AG for registered mail is € 25,00 at the time. ‘Quasimodo’ hereby notifies that the cancellation of a contract via Internet is not possible according to the legal regulations of the German Distance Selling Act (§ 312 b Abs. 3 Nr. 6 BGB).
2.3
A refund for tickets will only be granted upon cancelling of an event or when an event is shifted to another date. A refund of the presales charges or other fees is not possible, since those are considered already provided services. Registered customers of ‘Quasimodo’ who have obtained tickets via our website will be notified as quickly as possible about the cancelling of an event. The same applies for customers who have reserved tickets.
3. Reserving tickets online
‘Quasimodo’ offers to reserve tickets online. Reserving tickets is binding, but may be cancelled until 48 hours before the concert. If no cancellation is received, the tickets will be deposited at the evening counter and have to be paid in cash. Reserved tickets which have not been picked up will be billed by the ‘Quasimodo’, since the reservation act represents a binding legal contract.
4. Shifting the date of an event
4.1
‘Quasimodo’ may shift the time for an event up to one hour. Line up or program are also subject to alterations.
4.2
If the date of an event is changed, the tickets remain valid. The customer has the right to return the tickets according to No. 2.3 of these terms and conditions. We request the return of tickets prior to the changed date.
5. Wardrobe and liability
5.1
‘Quasimodo’ will only take liability for clothing items which have been handed over to our guarded coat check for a fee and a return badge. ‘Quasimodo’ will not be liable for any valuables left in the clothing items or bags.
5.2
In case the coat check badge gets lost, an additional fee of € 5,00 will be charged. A return of the requested item can only occur if the item can be undoubtedly attributed to the owner. ‘Quasimodo’ is not liable for lost, forgotten, swapped or stolen items outside the guarded coat check, unless ‘Quasimodo’ can be made responsible for the loss.
6. Rules of the house
6.1
‘Quasimodo’ reserves the right to refuse entry to ticket holders, if their entry violates the interests of ‘Quasimodo’. If the entry is refused, the ticket price will be refunded.
6.2
Entering the stage is prohibited for customers.
6.3
The Quasimodo has a no-smoking-rule.
6.4
The Quasimodo has a free choice of seats. There is no guarantee to be seated.
6.5
Audio, photo, film or video recordings – also for private use – are subject to prior consent of the Quasimodo. Noncompliance may result in exclusion from an event. ‘Quasimodo’ reserves the right to collect recording devices and cameras, which will be returned after the end of the event.
6.6
It is prohibited to carry weapons, fireworks, flammable liquids, gas, bottles, cans, drinks, animals or any potentially dangerous items. ‘Quasimodo’ reserves the right to carry out controls within the terms of its rules of the house.
6.7
Instructions by the Quasimodo staff have to be followed. These instructions primarily serve the security of our guests. The authority expands to the entrance area as well, since this is private property and ‘Quasimodo’ is exercising property rights here as well.
7. Data security
‘Quasimodo’ saves and processes data provided by the customer for the purpose of executing a contract. The data provided will only be used for the purpose of informing the customer (newsletter, information on program changes or cancelling of events). The customer may always request information on, correction, blocking or deletion of his saved personal data.
8. Final clauses
German law applies exclusively, with exception of the UN-Contracts for the international sales of goods (CISG). Place of execution is Berlin.Oral agreements cannot be made. Only written agreements will be considered valid. Any changes to the written form have to be made in written agreements.
